Events and Organisation:

These contractual Terms and Conditions are intended to establish the terms and conditions governing the provision of services for events organised by Maia Wildlife Safari Experiences, a company headquartered at Rue de la Gare 327, 2944 Bonfol, Switzerland, and registered at the Registre du Commerce de la République et Canton du Jura with the number CHE-226.256.358, between MWSE and the participant.

The organisation of the events is the responsibility of Maia Wildlife Safari Experiences , referred to in these terms and conditions as such or as MWSE.

​

These terms and conditions of participation are supplemented by the programme of the event at which the participant inscribes, which constitutes the particular conditions of participation in the event.

 

Even in the absence of a written contract, by contracting with MWSE the participant acknowledges and accepts all the terms and conditions established.

Responsibility:

MWSE's liability is guaranteed by liability insurance in the Bâloise Assurance with the contract n. 30/4.110.318-7, in accordance with the legislation in force.

Inscriptions and Payments:

The registration of the participant and his/her companions will only be valid after full payment or 30% of the value of the event. The participant undertakes to settle the balance of the cost of the event, including any additional services requested, within 60 days of the event date. If the registration takes place 60 days or less from the date of the beginning of the event, the total price of the event must be paid at the time of registration, which is conditioned to the confirmation of reservations for all services.  MWSE reserves the right to cancel any registration whose payment has not been made under the above mentioned conditions. 

 

By registering the participant makes several commitments to MWSE:

- To have taken note and accepted these terms and conditions of participation, as well as the programme of the event that the participant subscribes to, which constitutes the particular conditions of participation in the event.

- That he/she is in a health condition appropriate to the event to which he/she subscribes and accepts the nature of the event, including the risks arising from the impossibility of immediate access to medical assistance.

- That he/she is aware of the kind of physical, cultural and psychological demands that the trip may involve and that may lead to unforeseen situations.

Minimum age:

The minimum age of participation in the events is 12 years. Although many of the optional activities of the events may have a different minimum age. Underage participants may only take part in the events accompanied by both parents or only one, subject to applicable legislation.

Accommodation:

MWSE has a room for two people for its events. In some cases, it may be possible to put beds or mattresses in the parents' room for minors. Occasionally, accommodation may be in triple or more people's rooms.

If possible, single rooms can be arranged with an increase in the price of accommodation.

Documentation:

The participant is responsible for any personal or family documentation (identity card, passport, authorization for minors, visas, vaccination certificate and other possibly required) necessary for the event. MWSE declines all responsibility for refusing to grant a visa or not allowing the participant to enter a foreign country; in these cases, the conditions established in the "Withdrawals" clause apply, and the participant's account is also responsible for any and all costs that such situation may entail.

Use of participant's personal information:

The participant gives express consent for all information, including personal data, provided for the organisation of the event to be transmitted to government and other authorities for control and security purposes.

 

The participant gives express consent that all information, including personal data, provided in connection with the event may be transmitted to MWSE's local partners in order to carry out the programme of the event, including tastes, food preferences, particular health information or others.

 

MWSE will make the necessary contacts with the participant in order to ensure the proper functioning of the entire event.

Meeting point and timetables:

The meeting place of the participant, his companions, in each event with the guide or leader of the event and with the other participants is indicated in the program of each event. The specific place will be communicated to the participant in a timely manner before the beginning of each event.

 

It is the participant's responsibility to purchase the air travel, or other means of transportation, to take him/her and his/her companions to the place where the event begins. It is also the participant's responsibility to be at the meeting point at the time indicated for the beginning of the event and other activities.

Spoken language during the event:

MWSE events, with few exceptions, are held with groups of participants of various nationalities, so the language spoken in the events is English. Although guides or event leaders are usually fluent in other languages.

Date changes:

The participant registered for an event may not change his registration to another event or to the same event with arrival or departure on a different date without the express consent of MWSE. If such a change is possible, it may be subject to expenses and charges under the heading "Withdrawals".

Transfer of registration:

The participant may cede his registration, being replaced by another person who meets all the conditions required for the event, provided that he informs MWSE at least 60 days in advance of the date of the beginning of the event and that the different suppliers of the services of the event accept the replacement, under penalty of being considered that the participant has given up the event. If the participant wishes to cede his registration to a person of a different sex, he may be subject to the payment of an individual accommodation supplement or other cost of the same nature if this is not provided for the event for which he is registering, in the event that it is not possible to group the new participant with another person of the same sex.

 

The transfer of registration shall make the transferor and transferee jointly and severally liable for the payment of the event price and the additional charges incurred.

Changes:

Whenever there are other reasons that justify it, MWSE may change the program of the event, modify the departure times or replace any of the accommodations or transportation foreseen by others of similar category and location.

Withdrawals:

If the participant or any of his companions withdraws from the event up to 60 days before the start date of the event, he will lose 30% of the value of the event, which was delivered by the participant to MWSE under the condition of a non-refundable deposit. In case this withdrawal occurs 60 days or less before the start date of the event, the participant will lose the total value of the event. The participant will also lose the value of additional services that have been requested by him/her and that have non-refundable charges.

Refunds:

Once the event has started, no refund is due for services not used by the participant or his/her companions. Failure to provide services provided for in the program of the event for reasons attributable to MWSE and if it is not possible to replace them with other equivalent services, entitles the participant to be reimbursed for the difference between the price of the services provided and those actually provided.

Price changes:

The prices of each event are based on the costs of services and exchange rates in effect on the date of each event, so they may be subject to changes resulting from changes in the cost of transportation or fuel, duties, taxes, fees and exchange fluctuations.

 

Whenever there is a change in the price of an event, the participant shall be immediately informed and invited, within the time limit set, to accept the increase or cancel his registration under the same terms and conditions as those set out in the "Withdrawals" clause.

Insurance:

The participant undertakes to purchase medical and travel insurance. The insurance is adjusted to the period and duration of the event, destination and type of activity. By not purchasing medical and travel insurance or by purchasing inadequate insurance, the participant exempts MWSE and all its service provider partners from any and all liability for the risks and consequential costs incurred by the participant for not having carried out the protection recommended for him/her.

Complaints:

Complaints may only be submitted in writing within a period not exceeding 20 days after the end of the event. They can only be accepted if they have been submitted to the service providers (lodges, guides, local agents, etc.) during the course of the event or stay, requiring from them the respective documents proving the occurrence. 

 

Any conflict arising out of these Terms and Conditions shall be settled by the Tribunal Cantonal du Jura, Switzerland, with express waiver of any other and for all matters not governed by these Terms and Conditions of participation, Swiss law shall apply.

Note:

These Terms and Conditions are supplemented by the programme of the event in which the participant and his/her accompanying persons register, which constitutes the particular conditions of participation in the event. They may also be supplemented by any other specific conditions sent to the participant at the time of registration or any other provided that duly agreed by the parties.
